1. Acceptance of Terms
By accessing or using the services provided by Missouri City Restoration Worx (“we,” “our,” or “us”), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
2. Services
Missouri City Restoration Worx provides water damage restoration, flood cleanup, mold remediation, fire damage restoration, and related services. Our services are available 24/7 for emergency response in Missouri City and surrounding areas.
3. Scheduling and Appointments
When you schedule our services, we will make every reasonable effort to arrive at the scheduled time. However, due to the emergency nature of many of our services, we reserve the right to reschedule appointments as necessary. We will notify you as soon as possible in the event of any changes.
4. Payment Terms
Payment for our services is due as specified in the service agreement or invoice. We accept various forms of payment, including major credit cards, checks, and cash. For insurance claims, we work directly with most insurance companies, but the customer remains ultimately responsible for any costs not covered by insurance.
5. Service Warranty
We stand behind our workmanship and provide warranties as specified in your service agreement. This warranty is void if the affected area has been subject to misuse, neglect, or additional water or fire damage after the completion of our services.
6. Customer Responsibilities
To facilitate our services, customers agree to:
- Provide accurate information about the damage
- Grant reasonable access to the affected areas
- Secure valuables and remove fragile items from the work area when possible
- Notify us of any special conditions or concerns before work begins
7. Limitation of Liability
To the maximum extent permitted by law, Missouri City Restoration Worx shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services, even if we have been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless Missouri City Restoration Worx and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of our services or your violation of these Terms of Service.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically for changes.
